1. Acceptance of Terms

By creating an account, accessing, or using Klik., you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and Klik. ("Company," "we," "us," or "our").

2. Eligibility

2.1 Age Requirements

You must be at least 13 years of age to use Klik. If you are under 18 (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian to use the Service.

2.2 Regional Restrictions

If you are in the European Economic Area (EEA), United Kingdom, or other jurisdictions with digital consent laws, you must meet the minimum age requirements of your country (typically 13-16 years).

2.3 Account Limitations

You may only create and maintain one Klik. account. If we determine you have created multiple accounts, we may suspend or terminate all of them.

3. Account Registration & Security

3.1 Account Creation

To use Klik., you must register for an account by providing:

• A valid email address
• A unique username (handle)
• A display name

You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for:

• Maintaining the security of your account
• Protecting access to your email (used for login codes)
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.3 Authentication

Klik. uses passwordless authentication via one-time email codes. You are responsible for maintaining access to your registered email address.

4. The Service

4.1 Core Features

Klik. provides a photo and video sharing platform where users can:

• Join or create private groups ("Squads")
• Receive daily creative prompts
• Capture and share photos/videos in response to prompts
• View content from squad members after posting
• React to and comment on submissions
• Track participation streaks

4.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable for any modification, suspension, or discontinuation.

4.3 Service Availability

We do not guarantee that the Service will be available at all times. The Service may be interrupted for maintenance, updates, or circumstances beyond our control.

5. User Content

5.1 Your Content

"User Content" includes photos, videos, captions, comments, reactions, and any other content you submit through the Service.

5.2 Content Ownership

You retain ownership of your User Content. By submitting content to Klik., you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to:

• Host, store, and display your content to your squad members
• Modify content for technical purposes (e.g., resizing, format conversion)
• Use content to operate and improve the Service

This license terminates when you delete your content or account, except where copies exist in squad members' feeds or backups.

5.3 Content Standards

You represent and warrant that your User Content:

• Is original or you have rights to share it
• Does not infringe any third party's intellectual property rights
• Does not violate any applicable laws
• Does not contain harmful, illegal, or objectionable material

5.4 Content Removal

We reserve the right (but have no obligation) to remove User Content that violates these Terms or our Community Guidelines. We may also remove content in response to valid legal requests.

6. Prohibited Conduct

You agree NOT to:

6.1 Harmful Behavior

• Harass, bully, intimidate, or threaten other users
• Post content that is hateful, discriminatory, or promotes violence
• Impersonate any person or entity
• Stalk or invade the privacy of others
• Share non-consensual intimate images

6.2 Illegal Activities

• Upload illegal content or content depicting illegal activities
• Distribute malware, viruses, or harmful code
• Engage in fraud, phishing, or deceptive practices
• Violate any applicable local, state, national, or international law

6.3 Platform Abuse

• Attempt to access accounts or data without authorization
• Reverse engineer, decompile, or disassemble the Service
• Use bots, scrapers, or automated tools to access the Service
• Interfere with or disrupt the Service or servers
• Circumvent any security measures or rate limits
• Create multiple accounts or share accounts
• Misuse invite links or squad features

6.4 Commercial Misuse

• Use the Service for commercial purposes without authorization
• Advertise or promote products/services without permission
• Collect user data for commercial purposes

7. Intellectual Property

7.1 Our IP

The Service, including its design, features, graphics, logos, and software, is owned by Klik. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

7.2 Trademarks

"Klik." and related logos are trademarks of Klik. You may not use our trademarks without prior written consent.

7.3 Copyright Complaints

If you believe content on Klik. infringes your copyright, please contact us at legal@tryklik.wtf with:

• Description of the copyrighted work
• Location of the infringing content
• Your contact information
• A statement of good faith belief
• Your physical or electronic signature

8. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Disclaimers

We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security of data transmission

We are not responsible for:

• User Content posted by other users
• Conduct of other users on or off the Service
• Third-party websites or services linked from the Service

10. Limitation of Liability

In no event shall our total liability to you exceed the greater of (a) $100 USD or (b) the amounts paid by you to Klik. in the twelve (12) months preceding the claim.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply.

11. Indemnification

You agree to defend, indemnify, and hold harmless Klik., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of a third party

12. Termination

12.1 By You

You may stop using the Service and delete your account at any time through the app settings.

12.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in prohibited conduct
• Create legal risk or liability for us
• Fail to pay any applicable fees (if introduced in the future)

We may also terminate accounts that have been inactive for an extended period.

12.3 Effect of Termination

Upon termination:

• Your right to access the Service immediately ends
• Your User Content may be deleted
• You will be removed from all squads
• Sections that should survive termination will remain in effect

13. Dispute Resolution

13.1 Informal Resolution

Before filing a legal claim, you agree to contact us at legal@tryklik.wtf and attempt to resolve the dispute informally for at least 30 days.

13.2 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

13.3 Venue

Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of such courts.

13.4 Class Action Waiver

You agree that any dispute resolution will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Changes to Terms

We may update these Terms from time to time. When we make material changes:

• We will update the "Last Updated" date
• We will notify you through the app or via email
• We may require you to accept the new Terms to continue using the Service

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Klik. regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.
